Benjamin M. Eisner joined Cohen, Weiss and Simon LLP in 2022 as Of Counsel in the Employee Benefits group after more than 25 years as a partner at a Philadelphia union-side labor and employee benefits firm. He represents benefit plans, fiduciaries, plan sponsors, unions, labor-management committees and individuals in matters arising under ERISA, the Internal Revenue Code and the Labor Management Relations Act. He has handled numerous pension plan withdrawal liability matters and served as counsel to two ERISA pension plans experiencing mass withdrawal. He also has advised experienced practitioners on ethical issues that arise in the employee benefits practice, including those specific to multiemployer plans. Ben also acts as an independent fiduciary and trustee for two defined benefit pension plans. Ben also is an accomplished litigator, having among other matters successfully defended the fundamental New Jersey Constitutional Right of teachers in religious schools to organize and bargain collectively in South Jersey Catholic School Teachers Organization v. St. Theresa of the Infant Jesus Church Elementary School, 150 N.J. 575 (1997) before the New Jersey Supreme Court. Ben has held several leadership positions in the ABA Section of Labor and Employment Law’s Employee Benefits Committee (EBC) and served as the Union Co-Chair of the EBC from 2017 through 2020 and as Union Co-Chair of the EBC’s Ethics Subcommittee from 2010 through 2017. He now serves as a Senior Editor of the EBC’s respected treatise Employee Benefits Law. In addition to his American Bar Association involvement, Ben is a member of the AFL-CIO Union Lawyers Alliance (ULA) and has spoken on ethics and other subjects at ULA conferences. From 2010 through 2016, Ben was a Guest Lecturer in the Temple University Law School Graduate Tax Program, and now serves as an Adjunct Professor at Temple, teaching Employee Benefits. He is a Fellow of the American College of Employee Benefits Counsel, and of the American Bar Foundation. Ben graduated from Harvard Law School cum laude, served as a law clerk to the late Chief Judge John F. Gerry of the United States District Court for the District of New Jersey, and as Legislative Counsel to former U.S. Representative Peter H. Kostmayer (D-PA). He earned his undergraduate degree from Haverford College. |
