FEDERAL COURT APPROVES $285,000 SETTLEMENT IN WAGE-AND-HOUR LAWSUIT AGAINST CONSTRUCTION CONTRACTOR

A wage-and-hour lawsuit against a masonry subcontractor, brought on behalf of fifteen construction workers who laid bricks on residential construction projects throughout New York City, has resulted in a $285,000 settlement.  On November 18, 2016, the federal court in Brooklyn issued an order in Mauricio v. MSI, 14-cv-2657, approving the terms of the settlement between the plaintiffs and Masonry Services, Inc. and its owners.  The fifteen workers alleged in the suit that they regularly worked more than fifty hours per week without being paid the legally-required time-and-half for their overtime hours.  The suit also alleged that some workers, assigned to what they called a “Death Crew,” worked even longer hours, in harsh weather conditions, without overtime pay.

Cohen, Weiss and Simon LLP partner Evan Hudson-Plush spearheaded the litigation, which began in May 2014 and included extensive discovery and other court proceedings, including fourteen depositions.
